General Terms of Use

This Agreement ("Agreement") is by and between NameMedia.com ("NameMedia") a Delaware Corporation and You, Your heirs, agents, successors and assigns ("You"), and is made effective as of the date of electronic execution. This Agreement sets forth the terms and conditions of Your use of the NameMedia website and domain name services ("Services") and explains NameMedia' obligations to You and Your obligations to NameMedia.

This Agreement along with any other or additional NameMedia policies, together with any modifications that may be made hereto, constitute the complete and exclusive agreement between You and NameMedia. This Agreements supersedes all prior proposals, agreements, or other communications. All NameMedia policies and agreements specific to use of the NameMedia web site are incorporated herein and are made part of this Agreement by reference.

You acknowledge that You have read, understood, and agree to be bound by all terms and conditions of this Agreement and any other policies or agreements made part of this Agreement by reference, as well as any new, different or additional terms, conditions or policies which NameMedia may establish from time to time, and any agreements that NameMedia is currently bound by or will be bound by in the future.

You understand and agree that NameMedia operates this website on a commercial basis and that in consideration of your use of the site, you agree that you are bound to the terms and conditions herein with regard to your use of this website.

Term of Agreement and Modification:
You agree that NameMedia may modify this Agreement at any time and you agree to be bound by all changes that NameMedia may reasonably make hereto. If You conclude any purchase or other transaction with NameMedia the term of this Agreement shall continue in full force and effect as long as you (or your successors or assigns in interest to the subject of any transaction including any domain name(s) purchased) use and/or take advantage of the subject of that purchase or transaction.

Limitation of Liability:
NameMedia shall not be liable under any circumstances to you or any other person for indirect, incidental, consequential, special, exemplary or punitive damages, including loss of profit or goodwill, for any matter, whether such liability is asserted on the basis of contract, tort (including but not limited to negligence), breach of warranties, either express or implied, any breach of this agreement or its incorporated agreements and policies, and/or your inability to use any domain name or otherwise, even if NameMedia has been advised of the possibility of such damages.
